《德国民法典》的制定者自己也意识到，采用抽象概括的立法方式，虽然能够达到很大程度的法律稳定性，并使调整内容具有一般的公正性，但必须以放弃变化多端的生活关系本身所要求的细致化、放弃对具体案件作出公平处理为代价。为了减少抽象立法体裁的缺点，立法者在法典中规定了一些“一般条款”（Generalkauseln）。这些条款具有指令的特点，属于判断标准，其内容还要加以填补。……当然，《德国民法典》规定一些“一般条款”和“不确定的法律概念”，本身就是为了纠正抽象概括立法方式所产生的危险。

最近以来，这变通的意义变得更大了，因为联邦最高法院将分期付款买卖法用于所谓的“金融性分期付款买卖行为”（ Finanzierter Ratenkauf）在这种形式的分期付款买卖中，买受人不是将款项支付给出卖人而是支付给一个金融机构，而该金融机构已事先将全部价金付给了出卖人。由于这种行为给买受人产生了额外的风险，因而必须在更大程度上保护他的利益不受侵害。

而在“社会法”领域，某些自愿组合而成的团体（如工会、雇主联合会）或通过选举产生的利益代表机构（如企业委员会）也在参与着决定法律关系的形成。……不过，正确的是，这类团体或利益代表机构参与决定了经济生活和劳动世界各种条件的形成，它此承担着相应的责任。这是当代经济秩序和社会的一个基本特征，而且这一特征有不断增强的趋势。

认定存在习惯法与否，关键并不仅仅是它的实践，而是要看它是否具备了“必要的确信”（“opinio necessitat”），即人们是否普遍认为它是正确的。

然而，法律是为大家制定的，只要法律调整的不是非常专门的内容，那么它就应该使用一种与一般的交际语言和日常语言差别不是太大的语言。

因为这里涉及的是常年性疾病，这些人便在强迫观念能发生影响的生活领域为无行为能力，而在其他生活领域为有行为能力。这种观点是正确的。法律条文也是这种意思，因为第104条第2项并未规定在某些方面不能自由决定意志的情况。
